We are all familiar with the Illinois Freedom of Information Act (FOIA) (5 ILCS 140/1), which is used for the public to get information “documents” from a Public Body.
Under FOIA (5 ILCS 140/2 (C-5)) the Public Body is suppose to redact “Private Information”. The Act Defines Private Information as follows: “Private information” means unique identifiers, including a person’s social security number, driver’s license number, employee identification number, biometric identifiers, personal financial information, passwords or other access codes, medical records, home or personal telephone numbers, and personal email addresses. Private information also includes home address and personal license plates, except as otherwise provided by law or when compiled without possibility of attribution to any person.
Back in December of 2015 the Sangamon County Sheriffs Office released a police report with someone Full Name, Home Address, Phone Number, Driver’s License Number, Date of Birth, & Social Security Number. They released this information to the entire internet, as well a news media outlet.
The individual contacted the Sangamon County Sheriffs Office and asked for an investigation to be done, and filed a Professional Standards Complaint. Several weeks later the Chief Deputy of the Sangamon County Sheriff’s Office has failed to open an investigation or reply to the contact the individual has made to him.
The individual has since contacted the Sangamon County Sheriffs Office and stated if an internal affair investigation was not going to be done that he wished to press criminal charges against the employee under (5 ILCS 179/10 (A) (1) . The Sangamon County Sheriffs Supervisor refuses to make contact with the individual about filling a report for criminal charges. The City of Springfield IL Police stated that they could not write a report against another agencies staff that the individual would have to contact a Sangamon County Sheriffs Supervisor.
All because the Sangamon County Sheriffs Department doesn’t like the individual they believe its okay to break the law and share his personal information and get away with it. SHAME ON YOU!
