In 2015-OP-001043 King Vs Manuele (Plenary Order Was Entered), 2015-OP-001647 Manuele Vs Perkington (Case Dismissed), & 2015-OP-001648 Manuele Vs. King (Case Dismissed) Jasen Manuele has filed a 1203 Motion commonly know as a Motion to Reconsider.
The purpose of a motion to reconsider is to allow a party to bring to the court’s attention newly discovered evidence, changes in the law, or errors in the court’s previous application of existing law. Compton v. Country Mutual Insurance Co., 382 Ill. App. 3d 323, 331 (2008).
The purpose is not to re-argue what you have already argued. There must be new evidence that previously was not discovered, changes in the law, or errors in the court’s previous application of existing law, including the court mis-quoting a brief or making factual errors in their argument that are contradicted by the brief.
That right there is going to make Jasens Motion hearing very interesting.
Jasen filed this motion on 09/18/2015, which is the same day he filed another Order of Protection against Mr. Perkington and was denied it.
Mr. Manueles Motion Hearing is set for Oct 8, 2015 at 9:00 AM in Courtroom 5C, for all 3 cases.
This is clearly just an attempt to bully and harass the victims even more in these cases. It is very uncommon for a 1203 Motion to be granted on an Order of Protection Case. We will bring you more as the story unfolds after the Motion Hearing.
